These Terms and Conditions (“Terms”) govern your use of our website (the “Site”), purchases of shipping containers and Tiny House Capsules (the “Products”), and related services. By accessing our Site or placing an order, you agree to these Terms, which are governed by California law. If you do not agree, please do not use our Site or services.

1. Acceptance of Terms

These Terms form a binding contract between you (“Customer,” “You”) and Custom Cube Crafters (“We,” “Us”), a company operating under the laws of California. We may update these Terms at any time; continued use after changes constitutes acceptance per California contract law.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under California law to use our Site or purchase Products.

3. Products and Orders

• Product Descriptions: We aim for accuracy in describing our shipping containers and Tiny House Capsules. Images are illustrative; minor variations may occur.

• Order Process: Orders are subject to availability. We may refuse or cancel orders for reasons like pricing errors or fraud, as permitted by California Business and Professions Code § 17500.

• Custom Orders: Modifications (e.g., windows, insulation) are final once production begins.

4. Pricing and Payment

Prices are in U.S. dollars (USD) and exclude shipping and sales tax unless stated. You agree to pay all fees at checkout per our Sales Tax Policy. Payment protections are provided in accordance with California Civil Code § 1749.

5. Shipping and Delivery

• Processing & Delivery: Estimates are outlined in our Shipping Policy.

• Risk of Loss: Risk transfers to you upon delivery acceptance, per California Commercial Code § 2509.

6. Returns and Refunds

Returns and refunds follow our Return and Refunds Policy. Custom Products (e.g., modified Tiny House Capsules) are non-returnable unless defective, as allowed under California law for custom goods. Report issues within 7 days to sales@customcubecrafters.com.

7. Intellectual Property

All Site content (text, images, logos) and Product designs are owned by Custom Cube Crafters or our licensors, protected by California and U.S. copyright and trademark laws.

8. Privacy

Your personal data is handled per our Privacy Policy, which complies with the California Consumer Privacy Act (CCPA, Cal. Civ. Code § 1798.100 et seq.) and the California Privacy Rights Act (CPRA).

9. Warranties and Disclaimers

• Limited Warranty: New Products include a 1-year structural warranty; used Products have a 30-day satisfaction guarantee.

• As-Is: Used containers are sold “as-is” with possible imperfections (e.g., rust), per California Commercial Code § 2316.

• Disclaimer: Products are provided “as-is” without implied warranties (e.g., merchantability), to the extent permitted by Cal. Civ. Code § 1791.1.

10. Limitation of Liability

Custom Cube Crafters is not liable for indirect or consequential damages arising from your use of our Site or Products, per California Civil Code § 1668. Our total liability is capped at the amount you paid for the Product.

11. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of the State of California (Cal. Code Civ. Proc. § 1857).

• Disputes: Any disputes will be resolved in state or federal courts in Los Angeles County, California.

• Arbitration: At our discretion, disputes may be submitted to binding arbitration per the California Arbitration Act.
